What does a protected territory actually protect?

Territory language in the franchise agreement varies more than buyers expect. Here is what to look for.

Protected territory sounds simple. You get an area, and nobody else from the brand can open there. In practice, the words protect a lot less than people assume.

Read the exceptions

Many agreements protect you from another franchisee opening a location, but not from the brand selling online, through a grocery chain, or at an airport inside your zip codes. Some protections only last if you hit sales minimums.

Ask how it was drawn

Is the territory based on population, households, or a radius? A three-mile radius in a dense city and in a rural county are completely different businesses. For home services, the count of owner-occupied homes in your territory matters more than the size on a map.

Ask what is next to you

If the territories around yours are already sold, talk to those owners. If they are not, ask what the brand expects to sell there and when.

Your territory is your market for the next ten years. It deserves more attention than the logo.
